Unit 2 Discussion – Legal SystemCourse Objective
This assessment addresses the following course objective(s):
Demonstrate knowledge of substantive law including the American legal system, civil litigation, contracts, and business organizations.Discussion Prompt
Alex is a young entrepreneur who sells handmade necklaces made from local seashells she gathers near her home in St. Augustine, Florida. Alex sells her wares via the internet and ships them throughout the country using the United States Postal Service. Successful in her business, Alex buys a small cabin in Tennessee so that she can relax in the winters and enjoy nature. In an effort to grow her business, Alex has asked her friend Amber to loan her $75,000. Amber agrees but insists she must receive security in return. Amber secures a mortgage on the cabin for collateral. Alex uses the money to have a new warehouse constructed in Savanah, Georgia because she finds the shells better there. Two months into the construction, Snakeinthegrass Contractors goes out of business, leaving Alex nothing but a concrete slab for her money. Devastated, Alex quits the seashells business and stops paying Amber the monthly payments agreed upon. Amber calls and threatens to foreclose on the cabin. Upset, Alex drives to Mississippi where Amber lives and vandalizes her mailbox. Alex then moves to northern California and begins living in the forest.
If Amber wanted to foreclose on the cabin, which state has jurisdiction to hear the case and why? If Amber wanted to sue Alex for the damages to her mailbox, which state has jurisdiction and why? Could Alex sue the construction company while living in California? If so, which state has jurisdiction? Could Sam, a customer who bought a necklace from Alex and who lives in Rhode Island, sue Alex? If Alex now lives in California, in what state must he file suit? Be sure to discuss personal jurisdiction, subject matter jurisdiction, In Rem jurisdiction, and anything else relevant to our scenario.
Discuss whether or not the court has proper jurisdiction. You should discuss on what basis the court has jurisdiction, or in the alternative, why you believe it does not. What are the various types of jurisdiction the court must have and how must it be established?

Course Objective
This assessment addresses the following course objective(s):
Demonstrate knowledge of substantive law including the American legal system, civil litigation, contracts, and business organizations.
Discussion Prompt
Kenneth and Brandi decide to form a new law firm immediately upon graduating from law school. They will focus exclusively on animal abuse cases in the Chicago area. Brandi will contribute $19,000 and Kenneth will contribute $4000 to begin the business. The couple located a small office in eastern Chicago and immediately began hunting Craigslist for used furniture. Kenneth found some furniture in the price range and confirmed with the seller that it was still for sale. Following the directions in the ad, Kenneth immediately texted the seller that he would buy the furniture. The seller accepted at the list price and a pickup date was set. When Kenneth arrived with his truck, the seller apologized and stated he sold the furniture to a higher bidder the day after Kenneth made his offer. Distressed, Kenneth goes home and instead purchases furniture online for five times their original budget; nearly one-third of the firm’s entire operating budget. Brandi and Kenneth conclude the fiscal year with about $20,000 in their account. They decide to remove $1000 each for living expenses.
Consider the following in your response and support your conclusions using your textbook.
Did Kenneth form a binding contract with the Craigslist seller? If so, what contractual principles guide you?
Could Kenneth sue and if so, on what basis and for what damages?
What can Brandi do, if anything, if she became upset that Kenneth spent so much on the furniture?
What if Brandi refused to contribute financially to pay for the furniture?
Please be sure to validate your opinions and ideas with citations and references in APA format.

Instructions
Ted Brown and Jim Green have been discussing going into business together for several months, and they are anxious to start that business before the end of this month. However, both Ted Brown and Jim Green each have to be out of town for several weeks on other business, so Ted Brown has told his son, Theodore, who is 16, about the discussions with Jim Green and has appointed Theodore to complete negotiation of the final details of the business. Jim Green has told his son James, who is 18 years old, about the discussions with Ted Brown and appointed James to complete the negotiations.
The business that Ted Brown and Jim Green want to create will develop an app for cell phones that will identify family-oriented attractions along major highways so families can download the app to help in planning family vacations. The development of the app will take 4 months, and then it will take approximately another 4 months to fully deploy the app. As the app becomes popular, the business will solicit family-oriented businesses to advertise on the app. Ted Brown and Jim Green have very little capital to use in the development and deployment of the app and will probably need to raise the capital necessary to develop and deploy a quality app.
In your case study, address the questions below.
Can Theodore Brown and James Green legally create the business that Ted Brown and Jim Green have been discussing? Why, or why not?
If Theodore and James do create the business, what duties do they each owe their father? Describe what those duties mean in this case.
What factors do Ted Brown and Jim Green (or their sons on their behalf) need to consider in selecting a form for this business?
What form of business will provide the most advantage for their venture?
What are the disadvantages of the form of business that they selected?
Your case study should be at least four pages in length and include at least two outside sources, one of which must come from the CSU Online Library. Be sure to use APA formatting for all citations and references. Please note that no abstract is needed.

The debate paper is a 3-5 page paper (see writing requirements in the Syllabus)

The debate paper is a 3-5 page paper (see writing requirements in the Syllabus) that will focus on your research into this topic and how and why you have come to the conclusions you have. This means that you must support your argument with the law. Only factual findings are pertinent to this project. Your personal thoughts and beliefs will certainly guide you, but you need to use the law to argue the best outcome for your chosen side.
Please read the scenario below and then choose which side of the debate, (A) or (B), you want to research and argue. You will also need to submit a 3 – 5 page paper arguing your position on this topic. Both sides of the debate have valid arguments so don’t feel like you need to choose the “right” side of the argument. The important thing is to support your position with reasoned and thoughtful discussion, backed by research from pertinent sources including scholarly publications, media reports, and legal resources. Also, you must follow all aspects of APA!
Dr. Edward Powell is a pediatric nutritionist and is recognized as one of the country’s leading experts on the effects of nutrition and exercise on childhood obesity. He has conducted many years of research on the negative effects of obesity on the health and well-being of children and has been a leading advocate of national policies to encourage children to maintain a healthy weight. Dr. Powell is currently the head of a university research center on the topic of childhood obesity. The center is called The Research and Advocacy Center for Healthy Habits in Children and Adolescents. Recently, Dr. Powell and the Center have undertaken a large, nationwide research study to analyze and document the positive effects of exercise in mitigating the negative effects of unhealthy eating habits in children. The basic premise of the research study is that through a daily regimen of strenuous exercise, children can maintain a healthy weight although their eating habits and nutrition may be poor. Given the large scope of the research study, it will involve tracking the eating habits and exercise routines of hundreds of children across the country in different demographic categories. The study will involve more than 25 professional researchers and many more lab assistants, information technology specialists, and data analysts. Many of these individuals will be required to travel for large parts of the year, incurring expenses for transportation, lodging, and per diem. The study will be the most expensive of its type ever conducted, with the total cost expected to run over $2 million. Dr. Powell’s university has offered only limited financial support for the study.
In order to underwrite the huge costs of the research study, Dr. Powell has sought sponsorships from major US corporations. Recently, it has come to light that the two major corporate sponsors of the study are The Kiddie Kola Corporation (the largest US producer of sugary sodas marketed to children) and The Burger Shack (the largest chain of fast food restaurants in the United States, also with a predominant customer base of children). There has been a growing amount of criticism within the university and in the scientific community against Dr. Powell and the Center for accepting funding for the research study from these two corporate sponsors. These critics argue that sponsorship money from Kiddie Kola and Burger Shack will undermine the legitimacy of the study and tarnish the reputation of the Center and the university. Dr. Powell has responded that the university declined to provide adequate funding for the study and that he searched for many months for corporate sponsors not involved in the food industry, but none would agree to underwrite the costs of the study.
A) It is entirely unacceptable for Dr. Powell and the Center to accept sponsorship money from Kiddie Kola and Burger Shack. This sponsorship money will undermine the objectivity of the research and the legitimacy of the results. The only reason Kiddie Kola and Burger Shack are willing to pay the research costs is because they want to dictate the results in advance — namely, that it is perfectly okay for kids to eat fast food burgers and sugary sodas as long as they get enough exercise.
or
B) This is an unprecedented research study of major importance and benefit to the health and well-being of children in the United States. The results of this study will help inform national policy in the years ahead. Academic researchers need to cooperate with and build bridges to major corporations or important research studies will be left unfunded and undone, to the detriment of the public. Moreover, Dr. Powell is a leading expert in the field with decades of scientific research behind him. He is more than capable of ensuring that the funding provided by the corporate sponsors has no effect whatsoever on how the study is conducted or how the data is analyzed. He and the Center will publish whatever results the research uncovers, even if the results are harmful to the fast food and sugary soda industry.
